Data Deletion Policy
A. Introduction
Nadascore is an artificial intelligence (AI)-powered music intelligence platform operated by PT Multikanal Novel Seberkat Salihara ("Nadascore", the "Company", "we", "us", or "our"). We respect Users' rights to request the deletion of their Personal Data in accordance with applicable laws and regulations.
This Data Deletion Policy explains the procedures for requesting the deletion of accounts and/or Personal Data processed by Nadascore in connection with the use of its music analytics platform, market intelligence services, AI-powered features, third-party platform integrations, websites, applications, and other services provided by Nadascore (collectively, the "Services").
This Policy forms an integral part of the Privacy Policy, Terms of Service, and any other policies, guidelines, or terms that may be issued by Nadascore from time to time.
This Policy is prepared and interpreted in accordance with Law No. 27 of 2022 on Personal Data Protection and its implementing regulations, as amended from time to time ("PDP Law"), the General Data Protection Regulation (EU) 2016/679 ("GDPR"), where applicable, and any other personal data protection laws applicable to Users based on the relevant jurisdiction.
B. Legal Basis for Deletion Requests
Users may submit requests for the deletion of Personal Data in accordance with the rights granted under applicable laws and regulations, including but not limited to:
- Data subject rights as provided under the PDP Law;
- The right to erasure under Article 17 of the GDPR, where the GDPR applies to Processing activities carried out by Nadascore; and/or
- Similar rights granted under other applicable personal data protection laws.
The right to request deletion of Personal Data is not absolute and may be limited where retention of such data remains necessary, required, or permitted under applicable law.
C. Data That May Be Deleted
To the extent permitted under applicable law, Users may request the deletion of their account and Personal Data related to their use of the Services, including but not limited to:
- User account and profile information;
- Third-party platform integration data connected by the User;
- Customer communication and support data;
- Inputs and Outputs processed through AI features;
- Usage data associated with the User's account;
- Account preferences and configurations; and/or
- Other Personal Data processed by Nadascore in connection with the use of the Services.
D. How to Submit a Deletion Request
Users may submit a request for the deletion of their account and/or Personal Data through the features available within the Services or by contacting Nadascore via email at: hello@nadascore.com.
Before processing such a request, Nadascore may verify the identity of the requester and request additional information reasonably necessary to ensure that the request is submitted by an authorized party and to protect Personal Data from unauthorized access, modification, or deletion. Requests may also be submitted by an attorney-in-fact, guardian, curator, or any other party legally authorized to act on behalf of the data subject in accordance with applicable laws.
Nadascore reserves the right to refuse, limit, request additional clarification, or charge a reasonable administrative fee for requests that are excessive, repetitive, unfounded, disruptive, disproportionate, or where the relevant data must be retained to comply with legal obligations, resolve disputes, enforce legal rights, or for other legitimate purposes permitted under applicable laws.
E. Deletion Process and Timeline
Once a request has been verified, Nadascore will initiate the deletion process for Personal Data without undue delay in accordance with applicable laws and regulations.
In general, Nadascore aims to:
- acknowledge receipt of the request within no later than three (3) Business Days;
- complete identity verification within a reasonable period based on the complexity of the request;
- delete or anonymize Personal Data from active systems once the request has been approved;
- remove Personal Data from backup systems in accordance with applicable data retention and recovery cycles; and
- provide confirmation once the deletion process has been completed.
Unless otherwise required by applicable laws and regulations, an account and Personal Data will be deemed deleted once the deletion or anonymization process has been completed in Nadascore's active systems. For the avoidance of doubt, limited copies that remain stored in backup systems shall not be considered Personal Data that is actively processed and will be deleted or overwritten in accordance with the applicable retention cycle.
In certain circumstances, the implementation period may be extended where necessary to comply with legal obligations, conduct additional verification, handle complex requests, or for other reasons permitted under applicable law.
F. Data That May Be Retained
Notwithstanding a User's deletion request, Nadascore may retain certain data where required or permitted by applicable law, including for the following purposes:
- Complying with legal, tax, accounting, auditing, reporting, and compliance obligations, including maintaining transaction records, invoices, proof of payment, tax documentation, compliance documentation, and other business records required or reasonably necessary under applicable laws and regulations;
- Preventing, detecting, investigating, or addressing fraud, misuse of the Services, violations of the Terms of Service, illegal activities, spam activities, fraudulent re-registration attempts, security threats, or other activities that may harm Nadascore, other Users, or third parties;
- Maintaining the security of systems, networks, and technology infrastructure;
- Resolving disputes or enforcing legal rights;
- Demonstrating compliance with deletion requests;
- Retaining records, correspondence, and documentation relating to deletion requests for auditing, compliance, or legal evidentiary purposes;
- Retaining security logs, system logs, and fraud-prevention records necessary to maintain the security of the Services; and/or
- Any other purpose permitted under applicable laws and regulations.
Any data retained under this section will be used only for relevant purposes and only for as long as necessary.
G. Data Excluded From Deletion
Account deletion requests do not apply to:
- Data that has been permanently anonymized so that it can no longer be used to identify an individual;
- Aggregated data that is no longer associated with a User's identity;
- Data processed or controlled by third parties that are not under Nadascore's control, including but not limited to Google, YouTube, Meta, Instagram, TikTok, Anthropic, payment providers, cloud service providers, or other service providers;
- Data that must be retained under applicable law; and/or
- Information that is publicly available and lawfully obtained from public sources or licensed data providers.
Data that has been permanently anonymized such that it can no longer identify an individual is not considered Personal Data and may continue to be used by Nadascore for statistical, analytical, research, product development, service improvement, and other lawful purposes.
Users who wish to delete data processed by third parties must follow the deletion procedures applicable to the relevant third parties.
H. Artist and Roster Data
Nadascore may process information relating to artists, creators, musical works, social media accounts, music metadata, and other information lawfully obtained from public sources or licensed data providers as part of the provision of music analytics, market intelligence, and related services. Deletion of a User's account does not automatically result in the deletion of public information, metadata, or licensed data that was not provided by the User.
Where a User utilizes roster, artist management, label, studio, or similar features, account deletion will result in the deletion of data, configurations, OAuth connections, and other information specifically associated with the User's account. However, such deletion does not extend to public information or licensed data that Nadascore continues to process lawfully.
Where a User's account forms part of a workspace, roster, organization, label, artist management, studio, or other collaborative structure involving multiple users, deletion of the User's account will not automatically result in the deletion of data, reports, configurations, or records that are owned, controlled, or lawfully used by other users or the relevant workspace administrator. In such circumstances, Nadascore may retain data reasonably necessary to maintain the operational integrity of the workspace, fulfill contractual obligations to other customers, maintain activity records, or comply with applicable legal obligations.
I. Revocation of Third-Party Platform Access
Deletion of a Nadascore account will terminate Nadascore's access to any third-party accounts previously connected by the User, to the extent technically feasible. For additional protection, Users may also revoke Nadascore's access directly through the account settings of the relevant third-party platform. The processing, storage, and deletion of data by such third-party platforms are subject to their respective privacy policies and procedures, and deletion of an account on the Services does not automatically result in the deletion of data that is independently processed or stored by third parties outside Nadascore's control.
J. Deletion Is Final
Users may delete their account through the features available within the Services or by submitting a deletion request via email to hello@nadascore.com. For requests submitted via email, Nadascore may verify the identity of the requester before processing such a request.
Once the deletion process has been completed, the account will be deactivated and the associated Personal Data will be deleted or anonymized in accordance with this Policy. Deletion is permanent, and neither the account nor any Personal Data that has been deleted may be restored, except where required by applicable law.
Copies of data that remain stored in backup systems will be deleted in accordance with the applicable data retention schedule and data recovery procedure.
K. Data Subject Rights
A deletion request is one form of exercising data subject rights as provided under the PDP Law and other applicable laws.
In addition to the right to request deletion of Personal Data, Users may also have the right to obtain information regarding the Processing of their Personal Data, access their Personal Data, correct inaccurate Personal Data, restrict Processing under certain circumstances, withdraw previously given consent, object to certain Processing activities, obtain data portability where required by law, and lodge complaints with the competent authority.
Where required by applicable laws and regulations and technically feasible, Users may request a copy of certain Personal Data in a structured, commonly used, and electronically readable format for their own use or transfer to another data controller.
The exercise of these rights is subject to applicable laws and may be limited in certain circumstances as permitted by law.
L. Policy Changes
Nadascore may amend, update, or modify this Data Deletion Policy from time to time to reflect changes to the Services, business practices, technologies used, or applicable legal and regulatory requirements.
The latest version will be made available through Nadascore's website or platform and shall become effective on the date stated in the document.
